MapFlex Terms of Service

Agreement to Terms

By accessing or using the MapFlex mobile application and website ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

MapFlex is a personal travel tracking application that helps you document your travels privately and share your achievements externally when you choose.

1. Eligibility

1.1 Age Requirement

You must be at least 13 years old to use MapFlex. By using the Service, you represent and warrant that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws

1.2 Account Registration

To use MapFlex, you must create an account by providing:

• A valid email address
• A secure password
• A username

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

2. License and Restrictions

2.1 License Grant

Subject to these Terms, MapFlex grants you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the MapFlex app on your personal device(s)
• Use the Service for your personal, non-commercial purposes

3.1 Ownership

You retain ALL ownership rights to:

• Your check-ins and journal entries
• Photos you upload
• All personal data you create in MapFlex

MapFlex does NOT claim ownership of your content.

3.2 License to Us

By uploading content to MapFlex, you grant us a limited license to:

• Store your content on our servers
• Display your content back to you in the app
• Generate share cards when you request them
• Process your data to provide the Service

This license is:

• Non-exclusive (you can use your content elsewhere)
• For the sole purpose of providing the Service
• Terminated when you delete your content or account

3.3 Your Responsibilities

You are solely responsible for:

• The accuracy of your content
• Ensuring you have rights to upload photos
• The legality of your content
• Backing up your content (we recommend using "Download My Data")

3.4 Content Standards

Your content must NOT:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Contain hate speech, harassment, or threats
• Contain explicit sexual content or nudity
• Promote violence or illegal activity
• Contain spam or commercial solicitation

4. Privacy and Data Protection

Your use of MapFlex is governed by our Privacy Policy, which is incorporated into these Terms by reference.

4.1 Data Export and Deletion

You have the right to:

• Export all your data at any time (Settings → Download My Data)
• Delete your account at any time (Settings → Delete Account)
• 30-day grace period before permanent deletion

5. External Sharing

5.1 Your Choice to Share

MapFlex allows you to generate share cards and share them externally via Instagram, TikTok, Facebook, Twitter, WhatsApp, etc.

5.2 Referral Links

When you share, you may include a referral link:

• This helps you earn bonus points
• Your friends get bonus points when they sign up
• Referral links are tracked for attribution only
• No personal data is shared through referral links

6. Premium Subscription

6.1 Premium Features

MapFlex offers an optional Premium subscription for $4.99/month that includes:

• 10 photos per check-in (vs. 3 for free)
• 20+ premium share card templates
• HD quality share cards with no watermark
• Video recap generation (annual & monthly)
• Custom branding (remove MapFlex logo)
• Advanced analytics
• Priority support

6.2 Subscription Terms

Billing:

• Premium subscriptions are billed monthly
• Payment processed through Apple App Store or Google Play Store
• Prices are in USD (or local currency equivalent)
• Taxes may apply based on your location

Auto-Renewal:

• Subscriptions automatically renew unless cancelled
• You will be charged 24 hours before the end of your billing period
• Manage subscriptions in your App Store/Play Store account settings

6.3 Cancellation and Refunds

Cancellation:

• Cancel anytime through App Store or Google Play settings
• No cancellation fees
• Access to Premium features continues until end of billing period
• No partial refunds for mid-cycle cancellations

Refunds:

• All sales are final unless required by law
• Refund requests handled by Apple/Google (per their policies)
• Contact Apple/Google support for refund inquiries

7. Acceptable Use Policy

7.1 Prohibited Uses

You may NOT use MapFlex to:

• Document or promote illegal activities
• Violate any laws or regulations
• Infringe on intellectual property rights
• Harass, threaten, or abuse others
• Post hate speech or discriminatory content
• Attempt to hack or compromise the Service
• Upload viruses or malicious code
• Use automated tools without permission
• Send spam or unsolicited messages

7.2 Enforcement

If you violate these Terms, we may:

• Issue a warning
• Temporarily suspend your account
• Permanently terminate your account
• Report illegal activity to law enforcement
• Take legal action if necessary

8. Intellectual Property

8.1 MapFlex Ownership

MapFlex owns all rights to:

• The MapFlex app and website (code, design, functionality)
• MapFlex trademarks, logos, and branding
• Share card templates and designs
• All intellectual property not owned by users

8.2 Trademarks

"MapFlex" and the MapFlex logo are trademarks of MapFlex Inc. You may not:

• Use our trademarks without written permission
• Create derivative works using our branding
• Imply endorsement or affiliation without permission

9. Disclaimers and Limitations of Liability

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAPFLEX SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or use
• Damages resulting from unauthorized access to your account
• Damages from third-party content or external platforms

MAXIMUM LIABILITY: Our total liability shall not exceed the amount you paid us in the 12 months before the claim (or $100 if you're a free user).

10. Termination

10.1 By You

You may terminate your account at any time by:

• Using "Delete Account" in settings (30-day grace period)
• Emailing us at: support@mapflex.online

10.2 By Us

We may terminate or suspend your account immediately if:

• You violate these Terms
• You engage in fraudulent activity
• Required by law
• We discontinue the Service (with 30 days notice)

10.3 Effect of Termination

Upon termination:

• Your license to use the Service ends immediately
• We will delete your data after the 30-day grace period
• Provisions that should survive (disclaimers, limitations of liability) remain in effect

11. Changes to Terms

We may update these Terms from time to time. When we do:

• We'll update the "Last Updated" date
• We'll notify you via email or in-app notification
• Material changes require your acceptance
• Continued use after changes means you accept the new Terms

If you don't agree to updated Terms:

• Stop using the Service
• Delete your account (Settings → Delete Account)
